OFFICIAL RULES FARMERS' ALMANAC WORST WEDDING WEATHER CONTEST

OPEN TO LEGAL RESIDENTS OF 50 UNITED STATES AND DISTRICT OF COLUMBIA WHO ARE 18 YEARS AND OLDER AS OF DATE OF ENTRY
NOTE: BE SURE TO CAREFULLY READ THESE OFFICIAL RULES BEFORE ENTERING AS YOU WILL BE BOUND BY THEM
1. HOW AND WHEN TO ENTER: The "Farmers' Almanac Worst Wedding Weather Contest" starts at 12:01 AM, ET on 8/21/07 and ends 11:59:59 PM, ET on 2/14/08 ("Contest Entry Period"). Entry is on-line only. Visit www.farmersalmanac.com/worstweddingweather/ and follow the registration instructions. After you have completed registering, submit an essay, in strict compliance with the criteria and requirements stated in these Official Rules, describing how you and your spouse to whom you are currently married ("Spouse") experienced the worst weather on your wedding date. No essays will be accepted after 11:59:59 PM, ET on 2/14/08. Limit: One (1) essay submission ("Essay") per married couple.
2. ESSAY REQUIREMENTS: Your Essay must be entirely in English, not exceed 350 words, be written solely by you for this Contest and must state why you believe you and your Spouse experienced the worst weather on your wedding date. You must include the date, time and location of your wedding in your essay for weather verification purposes. As further described in these Official Rules, your Essay must not infringe or in any way violate any third party intellectual property rights, and it must be one in which you agree to transfer and assign all rights and title to Sponsor. Your Essay may not mention, contain, refer or otherwise allude to the name or logo of any person (other than your Spouse), company, business, brand, product, entity, or character. Your Essay may not contain any obscene, lewd, violent, offensive or otherwise inappropriate words, abbreviations, language, signs, symbols, political, personal and/or religious statements or references, or in any way reflect negatively upon the Sponsor as determined by the Sponsor in its sole discretion.
3. JUDGING CRITERIA & SELECTION OF WINNER: The Contest will consist of two (2) Rounds. ROUND ONE - (A) Selection of Semi-Finalist Essays by Panel of Qualified JudgeS: By or about 2/22/08, a panel of qualified judges consisting of Sponsor's representatives ("Contest Judges") will have reviewed all of the eligible Essays and selected a maximum of ten (10) of the highest rated Essays ("Semi-Finalist Essays) to participate in the on-line voting portion of the Contest. The Contest Judges will evaluate and rate the Essays according to the following three (3) criteria: (i) Uniqueness of Worst Weather Wedding Day Experience - 50%; (ii) Serenity and consequences of the weather on the wedding day - 25%; (iii) Originality and clarity of essay - 25%. In the event of a tied score, the Essay receiving the highest score for "Criteria (i) -" Uniqueness of Worst Wedding Day Experience" will be deemed the winner of the tie. In the event the tie still remains unbroken, the Contest Judges will break the tie by re-evaluating and re-rating the Essays based on "Criteria (i) -Uniqueness of Worst Weather Wedding Day Experience." (B) ROUND TWO - ON-LINE VOTING PORTION OF THE CONTEST: Beginning on or about 9:01 AM, ET on 2/29/08, Sponsor will post the selected Semi-Finalist Essays on its website, www.farmersalmanac.com/worstweddingweather. The on-line voting period of the Contest begins on or about 9:01 AM, ET on 2/29/08 and ends at 11:59:59 PM, ET on 3/17/08 ("Contest Voting Period"). To vote: review the Essays and submit your vote for your favorite Essay by clicking on the "I Cast My Vote For..." button located below each Semi-Finalist Essay. Once you have submitted your vote, you cannot change it. Limit: One vote per person per calendar day regardless of e-mail address used. After the Contest Voting Period has ended, the Submitter of the Essay who received the highest number of eligible votes during the Contest Voting Period will be deemed the potential Grand Prize Winner; the Submitter of the Essay that received the second highest number of eligible votes will be deemed the potential First Prize Winner, and the Submitter of the Essays that received the third highest number of eligible votes will be deemed the potential Second Prize Winner. In the event that the on-line voting results in a tie, the Submitter of the Essay who received the highest score in Round One from the panel of judges will be declared the winner of the tie. All Essay submitters agree that Sponsor has the sole right to decide all matters and disputes arising from this Contest and that its decisions shall be final and binding in all matters pertaining to this Contest. The potential winners will be notified by e-mail, phone and/or postal mail on or about 3/24/08. The potential Grand Prize Winner will be required to sign and return a notarized Affidavit of Eligibility/Compliance & Liability/Publicity Release, as allowed by law, and such other documents as may be requested by Sponsor, within the time period stated in the notification or Prize may be forfeited and awarded to the submitter of the next highest scoring Essay.
4. PRIZES & ODDS OF WINNING: Grand Prize (1): The Grand Prize shall consist of the Grand Prize Winner's Essay appearing in the 2009 Farmers' Almanac; a Windjammer(r) Barefoot Cruise for two ("Trip") on a Windjammer Barefoot Cruise Ship ("Ship") to either Aruba, West Indies, Virgin Islands, Costa Rica or another such island as will be decided by Winner, Sponsor and Windjammer; vow renewals by the Ship's Captain; Honeymoon Suite accommodation (dbl. occup.) aboard Ship; round-trip coach airfare for two from the major airport nearest to Winner's residence to major airport nearest to city of Ship embarkation (airfare in excess of $1,000 for Winner and travel companion is the sole responsibility of the Winner); ground transfers between airport and Ship, and "Trip goody bag." (Trip ARV: $6,050); and an official Farmers' Almanac Weather Survival Kit consisting of a personalized hardcover 2009 Farmers' Almanac ; a weather stick, ice scraper and umbrella (ARV: $41). (Total ARV: $6,091). All costs and expenses not specifically included herein, e.g. shore excursions and tours; Ship's physicians and nurses; personal purchases or services, including but not limited to the Ship's gift shops, spa, beauty salon, concessions, non-included food and beverages; gratuities for shipboard services not included in the Prize; insurance; rental cars, etc. are Grand Prize Winner's sole responsibility. Grand Prize Winner must take Trip on agreed upon dates or Grand Prize will be forfeited in its entirety without any further obligation on part of Sponsor. Trip must be concluded by 8/1/09 Grand Prize Winner and guest must travel on same itinerary and possess and present proper travel documents including photo identification prior to embarkation and throughout the Trip. Grand Prize Winner's guest must be his/her spouse unless otherwise agreed to by Sponsor. All federal, state and local taxes are the sole responsibility of the Grand Prize Winner. All Trip arrangements will be as determined by Sponsor. Sponsor shall have no liability for Grand Prize Winner's inability to utilize Trip. Restrictions may apply. First Prize: The First Prize Winner shall receive a Five Hundred Dollar ($500) L.L. Bean(r) Gift Card to be used for purchases at L.L. Bean retail stores or on-line at www.llbean.com; and an official Farmers' Almanac Weather Survival Kit consisting of a personalized hardcover 2009 Farmers' Almanac, a weather stick, ice scraper and umbrella (Total ARV: $541). Second Prize: The Second Prize Winner shall receive a One Hundred Twenty Five Dollar ($125) American Express(r) Gift Cheque s/he can use for dining at a participating restaurant s/he selects; and an official Farmers' Almanac Weather Survival Kit consisting of a personalized hardcover 2009 Farmers' Almanac, a weather stick, ice scraper and umbrella (Total ARV: $166). NOTE: Regardless of Prize won, Prize is not redeemable for cash; nor is it transferable or substitutable except by Sponsor with one of equal or greater value. L.L. Bean Gift Card and American Express Gift Cheque must be used in compliance with their respective terms and conditions and as allowed by law. Odds of winning depend on being selected as one of the Semi-Finalists in Round One of the Contest by the Contest Judges and receiving the most votes in Round Two of the Contest, the On-Line Voting Portion of the Contest, as both are described in Rule 3 above.
5. REPRESENTATIONS, WARRANTIES, & GRANT OF RIGHTS BY ESSAY SUBMITTER: Each individual who submits an Essay ("Submitter"), represents and warrants that the Essay is his/her own original work and has been legally created; does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party; has not been entered in or won previous contests or awards; and has not been published or distributed previously in any media. Additionally, each Submitter represents and warrants that s/he owns all rights and title to his/her Essay, including, without limitation, the copyrights and all other intellectual property rights in the Essay. By submitting an Essay, a Submitter irrevocably grants Sponsor and its affiliates, legal representatives, assigns, agents and licensees, the world-wide, royalty-free, unconditional, unlimited and perpetual right and permission to publish, re-publish, reproduce, copy, transmit, post, broadcast and/or televise, display, adapt, exhibit and/or otherwise use or re-use the Submitter's Essay, name, and city of residence, including, but not limited to, its publication or re-publication, as submitted or as edited/modified in any way by the Sponsor, in its sole discretion, in the 2009 or any other edition of Farmers Almanac to be offered for sale to the public by Sponsor, for commercial or other purposes on Sponsor's web sites, and in any and all media without limitation, worldwide and throughout perpetuity, without additional compensation, notice to, or approval from Submitter or any other party. EACH SUBMITTER UNDERSTANDS AND ACKNOWLEDGES THAT SUBMITTER WILL NOT BE PAID FOR OR RECEIVE ANY FORM OF COMPENSATION FOR HIS/HER ESSAY IN EXCHANGE FOR GRANTING SPONSOR THESE RIGHTS. Each Submitter waives all intellectual property rights, privacy/publicity rights or other legal or moral rights that might limit or preclude the Sponsor use of Submitter's Essay, and agrees not to sue or assert any claim against Sponsor & Others arising out of or connected with the posting, publishing, and/or use of the Essay or Submitter's personal information as listed above. Each Submitter specifically agrees to waive all claims to receive any royalties of any kind now or in the future from Sponsor, its advertising/promotion agencies, including NMA Entertainment & Marketing, their respective parents, subsidiaries, affiliates or licensees, successors and assigns and the officers, directors and employees of each (collectively, "Sponsor & Others") for any use of his/her Essay. Each Submitter further agrees to indemnify and hold Sponsor & Others, harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of them due to or in any way arising out of the use of Submitter's Essay, or the Submitter's conduct in creating the Essay or otherwise in connection with this Contest, including but not limited to claims for trademark infringement, copyright infringement; violation of an individual's right of publicity or right of privacy; or defamation. Each Submitter further agrees to release and hold harmless Sponsor & Others from any and all claims that any product or publication subsequently produced, presented, and/or prepared by or on behalf of Sponsor infringes Submitter's rights with regard to any elements, language or ideas contained in any Essay. Additionally, each Submitter agrees that s/he will cooperate with Sponsor or Sponsor's agent in obtaining all necessary affidavits, releases, warranties, and any other such documents as may be deemed necessary by Sponsor from his/her Spouse. Although all Essays will be reviewed by Sponsor before being judged, posted or published; the posting or publication of an Essay does not mean the Essay has been deemed to be in compliance with these Official Rules. Essays that do not comply with these Official Rules or that otherwise contain prohibited, or inappropriate content as determined by Sponsor, in its sole discretion, will be disqualified.
6. ELIGIBILITY: Contest is open to legal residents of the 50 United States and District of Columbia, 18 years and older as of date of entry who are legally married to the same Spouse whose wedding is described in the submitted Essay; except that persons who are officers, directors, or employees (and members of household or their immediate family, i.e. spouse, parent, child, or sibling and members of each of their households) of Sponsor & Others; prize providers and other individuals/entities associated with this Contest are not eligible to enter or win. The potential Grand Prize Winner must sign and return, within the time period stated in notification letter, an Affidavit of Eligibility/Compliance, Liability/Publicity Release, where allowed by law, Copyright Assignment Agreement and such other documents that may be requested by Sponsor or Prize may be forfeited and awarded to the eligible Submitter with the next highest number of votes. Grand Prize Winner must provide his/her Social Security Number and will receive a Form 1099 as required by law. Additionally, the potential Grand Prize Winner must cooperate with Sponsor in obtaining all necessary releases, affidavits and other documents from his/her spouse as Sponsor, in its sole discretion, deems necessary.
7. INTERNET: Sponsor is not responsible for interrupted or unavailable
network server or other connections, miscommunications, failed
telephone or computer transmissions or jumbled, scrambled or
misdirected entries (including Essays) or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person's computer related to participating in the Contest. Sponsor is not responsible for illegible, unintelligible, late, lost or stolen entries or incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest promotion or by any technical or human errors which may occur in the processing of any entries/Essays in this Contest. Persons found tampering with or abusing any aspect of this Contest, as solely determined by Sponsor, will be disqualified and may be subject to prosecution. If in the judgment of Sponsor, the Contest is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which corrupts the administration, security, fairness or proper play of the Contest promotion, Sponsor reserves the right, in its sole discretion to discontinue, suspend or terminate the Contest or to proceed in any manner Sponsor deems fair and reasonable. Any personally identifiable information collected during your participation in this Contest promotion will be collected by Sponsor and used by Sponsor and its agents solely for purposes of the proper administration and fulfillment of the Contest promotion as described in these Official Rules and will not be shared with any third party except as stated in Sponsor's Privacy Policy, posted online at http://www.farmersalmanac.com/privacy_policy and as allowed by law. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
8. GENERAL: Void in PR and where prohibited by law. By entering this
Contest, entrant agrees to abide by these official rules. All Federal, state
and local laws and regulations apply. The interpretation of these Official Rules shall be governed by the laws of the Commonwealth of Massachusetts. Any and all disputes will be resolved individually, without resort to class action, in the appropriate courts in the Commonwealth of Massachusetts exclusively, and subject to the laws of the Commonwealth of Massachusetts. Should there be a conflict between the laws of the Commonwealth of Massachusetts and any other laws, the conflict will be resolved in favor of the laws of the Commonwealth of Massachusetts. In addition to the consent and permissions granted above, entrants consent to the use of their name, essay, photograph and/or likeness for advertising and publicity purposes, in all media, worldwide, as determined by Sponsor without further compensation or consultation, except as otherwise stated herein or where prohibited by law. By participating, Winner releases Sponsor & Others from any and all damages, losses or injuries, whether property or personal, including death, whether direct or indirect, arising out of or due to or in connection with acceptance, use/misuse, or enjoyment of the Prize, participation in this Contest or Contest related events they will be held harmless against any such claims of liability. Sponsor is not responsible for late, lost, misdelivered/undelivered, stolen, incomplete or illegible Essays, entry submissions or mail. All federal, state and local laws apply. Void in Puerto Rico and wherever prohibited by law.
